TECHNICAL REVISION NO. 1 <br />SPEER MINING RESOURCE DRMS PERMIT NO. M- 1983 -176 <br />ASPHALT SPECIALTIES CO., INC. ("ASCI ") <br />Based on site monitoring inspections performed by the DRMS on June 2, 2014, August 4, 2014, and <br />August 14, 2014, weed control maintenance issues and restricted flows in a temporary trench serving as <br />a drain for mounded groundwater were found to be out of compliance with the DRMS mineral rules and <br />regulations for the approved permit on the Speer Mining Resource M- 1983 -176. The site has not been <br />mined since 2006 and is currently being operated as an inert landfilling operation backfilling the former <br />mined -out gravel pit. Based on the conditions noted during the site inspections, this Technical Revision <br />( "TR ") No. 1 has been prepared to address the Corrective Actions required by the DRMS to eliminate a <br />current weed infestation problem, develop a weed control plan and to relieve upgradient groundwater <br />mounding caused by the restricted flows in the temporary drain. <br />CORRECTIVE ACTION 1: There are state - listed noxious weeds currently on the permit area located in the <br />backfilled portion of the mine site on the lowest bench (termed the "3`d Bench ") and on the river <br />embankment adjacent to the South Platte River in the north- central portion of the permit area that <br />need to be controlled. A weed control plan had been developed only as part of the permit approval for <br />control of weeds after final reclamation in areas of native grass revegatation. A weed control plan shall <br />be developed and implemented for the site during mining and reclamation activities. <br />RESPONSE TO CURRENT WEED INFESTATION: Weeds currently on the site in the areas described <br />above will be sprayed with herbicides by a professional company from Littleton, Colorado who <br />have recently been on the site identifying noxious weed species and the herbicides to eradicate <br />or control them. A map consisting of Exhibit C -2 (the mine plan map for Amendment 4 to this <br />permit) at a reduced scale is being provided with this TR -1 showing the areas of weed <br />infestation. A copy of the paid invoice will be provided to the DRMS to show that this work was <br />completed. Both areas will be treated with the herbicides Export XP, Paramount or Vista <br />depending whether they are sprayed adjacent to the river or within the 3rd Bench which is a <br />significant distance from the river. Native grasses that have established in significant stands on <br />the 3rd Bench will not be adversely affected. Tamarisk treatment will consist of cutting the <br />shrubs to the stump and treating the stump with Garlon or Glyphosate. This action will be <br />completed in September to early October 2014. <br />RESPONSE TO WEED CONTROL PLAN: Since a weed control plan was never developed as part of <br />the permit approval for this site during active mining and reclamation, only for post -final <br />reclamation maintenance, ASCI commits to monitoring all areas within the permit boundary for <br />weed infestation and to control areas that have been invaded by state - listed noxious weeds by <br />mowing, tilling prior to seed fall, or in the case of small, isolated areas of intense infestation, <br />
