The weather was fine and dry, but the preceding weeks had been quite wet and a very <br />intense storm hit the site on July 30, where —3 1/2" of rain was recorded during —3 hours. One permitting action is <br />in progress, it is detailed under the heading GENERAL MINE PLAN COMPLIANCE. <br />For a more complete description of the state of New Elk Coal Company refer to the inspection report for <br />the New Elk mine. <br />AVAILABILITY OF RECORDS — Rule 5.02.4(1): <br />The records were available in the office used by Ron Thompson in the Technical Services building. More <br />details are given at the end of this report. <br />EXCESS SPOIL and DEVELOPMENT WASTE — Rule 4.09 <br />Placement; Drainage Control; Surface Stabilization: <br />Fills 7, 8 and 9 were inspected. The terraces and faces of all three fills were in good shape, with no sign of <br />any erosion. All of the fills were well vegetated. <br />Outside of fill 8 (east of the eastern downdrain), the flat spot had been graded to drain towards the <br />downdrain and the erosion below it had been repaired. The recent heavy rain had spoiled the repair a little, but the <br />damage was not significant. <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10; <br />Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13; <br />Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />All culverts at the site were inspected and were found to be clear and compliance, however a small amount <br />of sediment had accumulated at the inlet to C1 and should be cleared before it washes into the culvert. <br />Pond 9 (9B) was holding water but not discharging.
