Seneca II -W permit, comprised of 204.9 acres of disturbance and 204.9 acres of affected area. PR -6 <br />was approved January 6, 2012. At the time PR -6 was approved, the Division did not reflect the <br />removal of the affected acreage in the DRMS database. The Division will correct the reduction of <br />204.9 acres of affected area from the database with SL -5 approval. Approval of PR -6 reduced the <br />reclamation cost liability by $487,877.39. <br />SL -4 Phase I Bond Release Application <br />The SL -4 application applied for Phase I bond release of 138.7 acres. The approved reclamation <br />plan for the Seneca II -W Mine includes retention of specific permanent facilities including access <br />and light use roads, an electric substation and powerline, various fences associated with grazing <br />management, property boundaries, and shrub plots. Documentation to support retention of <br />facilities is found in Tab 20 Attachment 20 -2 of the permit application package. SCC submitted <br />TR77 to revise the permit to leave sediment ponds 005, 006, 009, 015, 016 and 017, and stock <br />ponds T -2, 3, 5, 18, 20, 24, 26 and 27 permanently in accordance with Rule 4.05.9(13). TR77 <br />was approved on April 8, 2013. Stock pond 22 was not approved to remain as a permanent <br />impoundment due to a lack of supporting information. The SL -4 bond release area encompassed <br />the following impoundments: sediment ponds 005, 006, 009, 015, 016 and 017, and stock ponds <br />T -2, 3, 5, 18, 20, 24, 26 and 27. Stockpond T -22 was not included in the SL -4 request. <br />Postmining drainage channels approved for release during SL -4 included portions of PM -21), <br />portions of PM -2 and a small portion of PM -2A. To the extent possible, drainage channels were <br />reestablished to their original natural pattern to minimize erosion, to conserve soil moisture, and <br />promote vegetation. Approved permanent drainages are shown on Permit Exhibit 20 -2 <br />" Postmining Topography and Drainage Map ". <br />Facilities previously approved for permanent retention and included in SL -4 approval were the <br />Vehicle Maintenance Shop and yard, water well house, fencing and the remaining power lines. <br />All required documentation to support the retention of these facilities has been provided within <br />Attachment 20 -2 of the permit. These facilities received Phase I bond release approval and will <br />still need to received Phase II and Phase III bond release approval. <br />During SL -4 evaluation, the Division determined that not all of the required remediation <br />activities of the Pit Ramp Slide Area had been completed in accordance with the approved plan <br />in Attachment 20 -E of Tab 20 of the permit. SCC submitted a minor revision (MR75) to revise <br />the remediation plan for the Pit Ramp Slide Area, based on NWCC findings. The Division <br />approved MR75 on August 7, 2013. Approval of MR75 revised Attachment 20 -E of the permit, <br />eliminating the requirement for construction of an underdrain system at the 9.4 acre Pit Ramp <br />Slide area. The Division approved Phase I bond release of the Pit Ramp Slide area with SL -4. <br />Drainage PM 4 -D was excluded from SL -4 due to formation of a gully in this drainage. The <br />Division required the operator to repair this gully prior to approval of SL -4 Phase I bond release. <br />SCC indicated they had not been able to repair the PM 4 -D drainage gully and requested this <br />drainage be removed from the bond release area. <br />Page 9 of 18 <br />
