r <br />The 2013 Decision Notice states "ESC shall furnish abond to insure Rill performance of <br />reclamation and mitigation ineasures on National Forest System lands based on the approved <br />reclamation plan ". <br />I will approve your Plan of Operations when I have written confirmation front the State that you <br />are in the process of updating your reclamation permit to include "native" grass and shrubs <br />sources. <br />You have provided clarification of your authorized agent, Robert Congdon, and included <br />additional language in Sections VI tlnu VIII of the Plan of Operations for Mining Activities on <br />National Forest System Lands farm FS- 2800 -5. <br />Mr. McCoy's letter dated July 2 assumes the State has bonded for the secondary escapeway and <br />the water well as depicted on the site map shown on your reclamation permit M 1999 -042 issued <br />January 2000. The FS is relying on individual line items prepared by the State inspector when <br />reviewing the State reclamation bond to determine the adequacy of your bond. If the escapeway <br />and water well are shown as line items in the bond calculation then it is covered, if it is not <br />included in the State bond calculation then it is not covered in your existing reclamation bond. <br />As previously stated and like the road re- route, the secondary escapeway and water well are <br />currently not bonded.
