Box 483 <br />Paonia, CO 81428 <br />Re: Bowie No. 2 Mine (Permit No. C- 1996 -083) <br />2" d Quarter 2014 Waste Bank Inspection Report <br />June 2014 VWP Monitoring Results <br />Adequacy Review <br />Dear Mr. Bear: <br />The Division has received and reviewed the 2nd Quarter Waste Bank Inspection Reports <br />and the June 2014 Vibrating Wire Piezometers (VWPs) Results report for the Bowie No. <br />2 Mine submitted by J.E. Stover & Associates on behalf of Bowie Resources, LLC (BRL). <br />Based on our review of the reports, we have the following comments: <br />1. The report notes that the slope on the west side of the first bench of Gob Pile #1 is <br />approximately 1.5H:1V, and the approved slope is 2H:1V. The approved slope <br />configuration was the basis for demonstrating that the pile would attain the <br />required long -term minimum static safety factor of 1.5, and is an integral part of the <br />reclamation success standard that must be met under Rules 3.03, 4.09, and 4.10. As <br />such, the current configuration is not consistent with the approved construction <br />requirements and reclamation plan. BRL must either reconstruct the Gob Pile #1 as <br />designed or submit a revised construction and reclamation plan that demonstrates <br />that the current configuration meets the requirements of Rules 4.09 and 4.10. <br />2. The report includes a statement that the available volume of coverfill material is <br />sufficient to meet the requirements of Rule 4.10.4(5) and the material balance in the <br />currently approved permit application package. The report does not include any <br />supporting data for this statement.
