Please specify how seed will be applied to the reclaimed area, i.e. drill seeded, <br /> broadcast, etc. In addition, describe how the seed bed will be prepared. A firm, weed-free <br /> seed bed is necessary for successful establishment of vegetation. <br /> 6. Please specify if the trench will be backfilled during the winter season. In addition, describe <br /> how the trench will be safeguarded during active prospecting operations. <br /> 7. Please specify if it will be necessary to remove trees from the proposed prospecting location. <br /> If so, specify how the trees will be properly disposed of or dispersed. <br /> 8. The applicant has stated there is very little topsoil present at the proposed prospecting <br /> location. The surface horizon may not be a true topsoil layer, but it will contain the greatest <br /> amount of nutrients and organic matter and should be salvaged. Please commit to salvaging <br /> the top 6-8 inches of soil across the entire prospecting site. <br /> 9. The Division recommends applying mulch to the reclaimed area due to the limited amount of <br /> available topsoil and organic matter. Please respond. <br /> 10. Please describe how the stockpiles will be stabilized and protected from erosion. If the <br /> stockpiles remain in place for more than one growing season, then they shall be seeded with <br /> a cover crop such as oats. Short term stabilization can be achieved using silt fences or straw <br /> bales. <br /> 11. The Applicant has specified the total project area to be disturbed is 1 acre. Please clarify if <br /> the 1 acre area includes the stockpile storage areas, equipment storage areas and the existing <br /> disturbance. <br /> 12. Please specify if you have applied for a Notice of Intent or a Plan of Operations with the US <br /> Forest Service (USFS). In addition,please commit to providing the Division with a copy of <br /> the USFS authorization to proceed with this project. <br /> Be advised that if these items have not been addressed within 60 days of the date of this letter <br /> (October 13, 2014), the Division may terminate the NOI application in accordance with Rule <br /> 5.1.3(c) of the Hard Rock Rules. <br /> Please remember to designate as appropriate those materials in the application that you desire to <br /> be made confidential versus those to be made public. Additionally, if you have received any <br /> pertinent correspondence from the US Forest Service, please forward copies to the Division. <br />
