opportunity to inspect,test and operate the installation, and shall correct any <br /> deficiencies inconsistent with the terms of this Agreement identified by the Rodmans. <br /> C. The cistern system, one-inch tap and temporary water service line will meet the <br /> historical water needs of the Rodman's Property. <br /> D. Greeley shall provide the water free of charge so long as this Agreement is in <br /> effect. <br /> 3. Terms and Conditions. <br /> A. Notwithstanding the above installation deadline, if inclement weather interferes <br /> with the completion of the installation, the service line will be completed as soon as <br /> weather conditions permit. <br /> B. City water is being delivered solely for historical uses on the Property, and/or for <br /> uses that are lawful under the Rodmans' well permit(s)and/or water court decrees. <br /> The Rodmans shall not sell any of the water supplied by Greeley, use the water off <br /> of the Property,waste the water, or use the water for any other purpose except those <br /> for which the water from the wells on the Property had been historically used prior <br /> to Greeley's dewatering operations at the 25th Avenue Site, and/or except those <br /> purposes which are lawful under the Rodmans' well permit(s) and/or water court <br /> decrees. <br /> C. [Per Andy Nicewicz's March 11 note, the Rodmans prefer to delete the previous <br /> broad language regarding abiding by all ordinances and laws, and replace it with <br /> terms specific to the cross-connection ordinance.] <br /> D. After the installation of the cistern system,water line and tap, Greeley will <br /> maintain the water line and tap up to the Rodmans' meter. The Rodmans shall be <br /> responsible for maintenance of the cistern system and line after the meter. <br /> E. This Agreement shall automatically terminate, and Greeley will disconnect the <br /> water line and tap and cease supplying water to the Property six(6)months after <br /> either: (1) dewatering operations at the 251h Avenue Site have ceased; or(2)the <br /> gravel pit at the 25th Avenue Site is lined with impervious material. Greeley shall <br /> be responsible for all costs associated with disconnection of the water line and <br /> tap, reinstalling the pumps in the wells,and restoring the Rodmans' well system <br /> to the extent practicable. If the gravel pit at the 25th Avenue Site is lined with <br /> impervious material, and if the Rodmans reasonably conclude that such lining is <br /> adversely affecting the production of their well(s), Rodmans may request Greeley <br /> - at Greeley's own expense-to review the issue and undertake appropriate <br /> mitigation measures. Consistent with the Inspection Report of the Colorado <br /> Division of Reclamation, Mining and Safety("DRMS") issued after DRMS' <br /> April 7, 2014 inspection of the 25th Avenue Site(the report has a signature date <br /> of April 28, 2014), Greeley shall complete all required mitigation measures <br /> 2 <br />
