&t-9A'Y <br /> AGREEMENT TO PROVIDE TEMPORARY CONNECTION TO CITY OF GREELEY <br /> POTABLE WATER SUPPLY <br /> THIS AGREEMENT TO PROVIDE TEMPORARY CONNECTION TO CITY OF <br /> GREELEY POTABLE WATER SUPPLY ("Agreement") is made this day of <br /> 52014,by and between William A. Rodman and Dorothy E. Rodman("the <br /> Rodmans"), whose address is 3613 W. F Street, Greeley, Colorado 80631, and the City of <br /> Greeley, Colorado, ("Greeley"), a Colorado municipal corporation, whose address is 1100 1Oth <br /> Street, Greeley, Colorado 80631. The Rodmans and Greeley are referred to collectively herein <br /> as the "Parties." <br /> WHEREAS, Greeley is conducting dewatering operations at a gravel pit designated by <br /> the Division of Reclamation, Mining and Safety as Mine Permit No. M-2002-020 ("25th Avenue <br /> Site"); <br /> WHEREAS, the Rodmans own property whose street address is 3613 W. F Street, <br /> Greeley, Colorado, 80631 ("Property"), and two water wells with Permit Nos. 3597-F-R and <br /> 055880-F. The well with Permit No. 3597-F-R was decreed by the District Court, Water <br /> Division No. 1, in Case No. W-4715, as amended on October 3, 1975. Both wells(3597-F-R <br /> and 055880-F)are in the Cache La Poudre Augmentation Association Plan, decreed by the <br /> District Court,Water Division No. 1, in Case No. W-7921(75). The Property is described in <br /> Exhibit A, attached hereto and incorporated herein by this reference. <br /> NOW, THEREFORE, in consideration of the premises, the above recitals, and the mutual <br /> covenants and promises of the Parties,the Rodmans and Greeley agree as follows: <br /> 1. Consideration. Greeley shall cause the Property to be connected to, and provided with, <br /> temporary potable water service in consideration of the Rodmans' full release of claims <br /> related to Greeley's dewatering operations at the 25th Avenue Site as set forth in this <br /> Agreement and in the Agreement for Mutual Release (to which this Agreement is attached as <br /> Exhibit B). <br /> 2. Installation of cistern, water line, and tan. <br /> A. Within 80 days of the execution of this Agreement, a 10,000 gallon cistern,with <br /> 230 volt pump and ancillary piping capable of pumping 30 gpm to meet the needs of <br /> the irrigation system (referred to as cistern system)and one-inch(1")tap and <br /> temporary water service line shall be installed, at Greeley's expense,to the Property. <br /> B. The cistern system and water line shall be installed in accordance with City of <br /> Greeley Water and Sewer standards and connected to the existing valving at the <br /> current pump house on the Property. The installation shall include removal of <br /> existing pipe and valve works from the wells, and the existing well pumps will be <br /> removed from the wells. The Rodmans shall incur no expense with respect to the <br /> installation and pump removal. Greeley shall allow the Rodmans a reasonable <br /> 1 <br />
