Under the "Description of Operations/Locations/Vehicles" section of the form, indicates the policy covers Peabody Sage Creek Mining, LLC. And not Moffat County Mining. Also, this section indicates the insurance policy covers operations in Routt and Moffat Counties, Colorado and Carbon County, Wyoming as well as the Mesa Gravel Pit. Given this, it is unclear if the coverage limits meets the minimum coverage required by Rule 2.03.9(1) for bodily injury and property damage for the Williams Fork Mines. Please clarify. Rule 2.04.10 — Vegetation Information 1) The first sentence of the currently approved Page 2.04 -34 has been cut off on revised Page 2.04 -34. Please submit a revised page with the first sentence at the top of the page. a. MCM Response: Page 2.04 -34 has been revised to include the missing text, and the revised page is included with these responses. b. DRMS Response: This item is resolved. Rule 2.04.11— Fish and Wildlife Resource Information 1) The Division has received comments back from Colorado Parks and Wildlife in regards to MCM's proposed TES listing. Colorado Parks and Wildlife finds that the list of species for Moffat County is accurate except for one Candidate Species, the Greater Sage Grouse. Please add the Greater Sage Grouse to the TES listing. a. MCM Response: MCM has revised the listing and discussion of potential TES species to include current information on the known occurrence and status of the Greater Sage Grouse. The revised TES information accompanies these responses for replacement in the PAP. b. DRMS Response: The Division is required to forward updated TES information to the Office of Surface Mining (OSM) to determine if a Section 7 consultation is required. The Division has forwarded the revised pages in regards to this item to the OSM on May 13, 2014. The Division will notify MCM if any revisions to the information submitted are required. c. DRMS Response: On July 14, 2014 the Division received a memorandum dated July 8, 2014 from the Office of Surface Mining regarding the section 7 consultation. This memorandum is enclosed for your review. The memorandum indicates that a Section 7 consultation with the US Fish and Wildlife Service is not necessary at this time. This item is considered resolved. 2) Please revise Page 2.04 -34 and 2.04 -40 to indicate additional threatened and Endangered Species information can be found in Exhibit 15a.
