Please review Maps #1 and #2 as well as the revised pages and ensure all
the surface owners and coal owners are depicted on the map and listed on
the revised pages.
Rule 2.03.8 — Permit Term Information
1) Rule 2.03.8(2) requires the applicant to cite the anticipated number of acres of surface
lands to be affected during the permit term. Please revise section 2.03.8 of revised page
2.03 -19 to indicate if any additional surface acres will be disturbed during this permit
term. Also, please indicate the number of surface acres currently disturbed at the site.
2) Revised Map 24 scale is too small to read the dates and other information provided on the
map image. Also, the vertical extent of the proposed underground mine working are not
visible or not depicted on the map. Please increase the scale of Map 24 so the required
information is visible and indicate the vertical extent of the underground mine workings.
a. MCM Response to items 1 and 2: Page 2.03 -19 has been revised to include
disturbed and affected acreage information, and the revised page is included with
these responses. Map 24 has been revised to delete the information on mining
dates for areas already mined and add coal seam elevation data.
b. DRMS Response #1:
i. Item #1 is resolved
ii. Item #2: Rule 2.03.8 for underground mining activities, requires that the
applicant state the anticipated and actual starting date and termination
date of each phase of the underground mining activities. Please revise
Map 24 to indicate the actual starting and termination date for each phase
of the underground mining operation.
Rule 2.03.9 — Personal Iniury and Property Damage Insurance
1) Please revise Exhibit 1 with the most recent insurance certificate.
a. MCM Response: The current insurance certificate is included with the
responses for replacement in Exhibit 1.
b. DRMS Response: Please address the following items in regards to the updated
certificate of liability insurance:
i. The certificate holder listed on the updated form is Routt County Board
of Commissioners. The Colorado Division of Reclamation, Mining and
Safety should be listed as the certificate holder.
