MCM Response: Page 2.04 -34 has been revised to include the missing text, and <br />the revised page is included with these responses. <br />b. DRMS Response: This item is resolved. <br />Rule 2.04.11— Fish and Wildlife Resource Information <br />1) The Division has received comments back from Colorado Parks and Wildlife in regards <br />to MCM's proposed TES listing. Colorado Parks and Wildlife finds that the list of <br />species for Moffat County is accurate except for one Candidate Species, the Greater Sage <br />Grouse. Please add the Greater Sage Grouse to the TES listing. <br />a. MCM Response: MCM has revised the listing and discussion of potential TES <br />species to include current information on the known occurrence and status of the <br />Greater Sage Grouse. The revised TES information accompanies these responses <br />for replacement in the PAP. <br />b. DRMS Response: The Division is required to forward updated TES information <br />to the Office of Surface Mining (OSM) to determine if a Section 7 consultation is <br />required. The Division has forwarded the revised pages in regards to this item to <br />the OSM on May 13, 2014. The Division will notify MCM if any revisions to <br />the information submitted are required. <br />c. DRMS Response: On July 14, 2014 the Division received a memorandum dated <br />July 8, 2014 from the Office of Surface Mining regarding the section 7 <br />consultation. This memorandum is enclosed for your review. The memorandum <br />indicates that a Section 7 consultation with the US Fish and Wildlife Service is <br />not necessary at this time. This item is considered resolved. <br />2) Please revise Page 2.04 -34 and 2.0440 to indicate additional threatened and Endangered <br />Species information can be found in Exhibit 15a. <br />3) With the submittal of TR36, a map was included that depicts the Greater Sage- Grouse <br />and Columbian Sharp- tailed Grouse active and inactive/historic leks. Also, a copy of an <br />e -mail from the Colorado Division of Parks and Wildlife was included. It is unclear if <br />this information was to be included in the permit document. It would be appropriate to <br />add this information Exhibit 15a. Please add these documents to Exhibit 15a with a brief <br />introductory statement of the purpose of this information. <br />
