MCM Response to items 1 and 2: Page 2.03 -19 has been revised to include <br />disturbed and affected acreage information, and the revised page is included with <br />these responses. Map 24 has been revised to delete the information on mining <br />dates for areas already mined and add coal seam elevation data. <br />b. DRMS Response #1: <br />i. Item #1 is resolved <br />ii. Item #2: Rule 2.03.8 for underground mining activities, requires that the <br />applicant state the anticipated and actual starting date and termination <br />date of each phase of the underground mining activities. Please revise <br />Map 24 to indicate the actual starting and termination date for each phase <br />of the underground mining operation. <br />Rule 2.03.9 — Personal Iniury and Property Damage Insurance <br />1) Please revise Exhibit 1 with the most recent insurance certificate. <br />a. MCM Response: The current insurance certificate is included with the <br />responses for replacement in Exhibit 1. <br />b. DRMS Response: Please address the following items in regards to the updated <br />certificate of liability insurance: <br />i. The certificate holder listed on the updated form is Routt County Board <br />of Commissioners. The Colorado Division of Reclamation, Mining and <br />Safety should be listed as the certificate holder. <br />ii. Please clarify which coverage limits listed on the form covers bodily <br />injury. <br />iii. Please clarify which coverage limits listed on the form covers property <br />damage. <br />iv. Under the "Description of Operations /Locations/Vehicles" section of the <br />form, indicates the policy covers Peabody Sage Creek Mining, LLC. And <br />not Moffat County Mining. Also, this section indicates the insurance <br />policy covers operations in Routt and Moffat Counties, Colorado and <br />Carbon County, Wyoming as well as the Mesa Gravel Pit. Given this, it <br />is unclear if the coverage limits meets the minimum coverage required <br />by Rule 2.03.9(1) for bodily injury and property damage for the Williams <br />Fork Mines. Please clarify. <br />Rule 2.04.10 — Vegetation Information <br />
