Box 670 <br />Hayden, CO 81639 <br />July 31, 2014 <br />Re: Seneca II West 2013 Annual Reclamation Report Review <br />Dear Mr. Karo: <br />The Division has reviewed Seneca Coal Company's 2013 Annual Reclamation Report. <br />The Division has two concerns regarding the report. <br />Permit text (Tab 21 page 30 -31) states that, "there is sufficient topsoil to apply a standard <br />average replacement 1.1 feet over the remainder of the graded area. Within the standard <br />1.1 foot average replacement thickness areas, the minimum thickness in any particular <br />location will be 9 inches." <br />The 2013 ARR reports that the remaining topsoil balance will allow for topsoil <br />replacement thickness of 0.7 feet (8.4 inches). <br />1. Please, provide an explanation of this variance from the approved topsoil <br />thickness replacement thickness. <br />On the Annual Reclamation Report DRMS form there is a discrepancy in the acres <br />reported as having received Phase I Bond Release. <br />SCC has reported the following values: <br />2012 ARR submitted 4/1/2013: <br />Total number of acres disturbed= 1,381.9 <br />Phase I Bond Released= 1, 15 1.45 acres <br />Acreage in long term mining or reclamation facilities= 177.1 acres <br />1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http: / /mining.state.co.us <br />John W.
