July 23, 2014 C- 1981- 012/New Elk Mine JLE <br />Colorado Department of Health should be close on issuing their approval of the use of a flocculent to help settle <br />out sediment in this pond. The emergency spillway was lined with rip -rap and appeared functional. The primary <br />spillway was clear and functional. <br />Ditches D24, D2413, D24D, D25A, D29, D15, and D32 were observed. These ditches were maintained and were <br />functional. Culvert 34 was functional. <br />Pond 00 IA was holding water. The operator was not pumping water to this pond at the time of the inspection. <br />The emergency spillway was clear and functional. The primary spillway culvert appeared to be clear and <br />functional and the pond was not discharging. <br />Pond 004a was holding a small amount of water. Willows and other wetland vegetation has established <br />throughout the site. The pond was not discharging and the embankment appeared stable. The primary and <br />emergency spillways were clear and functional. <br />Pond 008 was holding water but was not discharging. The primary and emergency spillway was clear and <br />functional. <br />Containment area 3 was dry. Areas 4 and 5 were holding a small amount of water. <br />ROADS — Rule 4.03 <br />Construction 4.03.1(3)/4.03.2(3) <br />Drainage 4.03.1(4)/4.03.2(4) <br />Surfacing and Maintenance4.03.1(5) and (6)/4.03.2(5) and (6) <br />Reclamation 4.03.1(7)/4.03.2(7): <br />The access road to the top of the refuse disposal area was observed. Some minor rilling was observed on the road <br />but overall the drainage ditches are functional. <br />REVEGETATION — Rule 4.15 <br />Vegetative Cover; Timing: <br />The injection well site located at the SAE south of the sediment drying area was observed. According to Mr. <br />Terry, this well site area and a portion of the access road was recently seeded. Some perennial grasses were <br />beginning to establish. The primary vegetation at the site was annual vegetation. The side ditch on the east side <br />of the well pad has a small center channel rill forming but overall appears functional. <br />SUPPORT FACILITIES - Rule 4.04: <br />The main portal area near the mine office was inspected. The scarp above the portal area has turf matting in place <br />and it appears vegetation is beginning to establish on this area.
