I, Jared Ebert of the Colorado Division of Reclamation, Mining and Safety conducted the <br />inspection. Mr. Vince Massarotti accompanied me during the inspection. The weather was clear and sunny. <br />BACKFILL and GRADING — Rule 4.14 <br />Contemporaneous Reclamation 4.14.1; Approximate Original Contour 4.14.2; Highwall Elimination 4.14.1(2)(f); <br />Steep Slopes 4.14.2, 4.27; Handling of Acid and Toxic Materials 4.14.3; Stabilization of Rills and Gullies 4.14.6: <br />Fill 9 was observed. The upper face of the fill has sparse vegetation established. The terrace ditches have been <br />maintained and appear functional. <br />Fill 7 was observed. The ditch that diverts water from the upper road into the Fill 7 drainage system on the north <br />east side has been repaired and a new check dam has been constructed to help slow the water flow. The terrace <br />drains have been maintained and appear functional. <br />Fill 8 was observed and appears stable. The face of the fill has good perennial grass established. The drainage <br />system on the fill has been maintained and is functional. <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.053; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10; <br />Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13; <br />Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />Pond 009 was holding water but was not discharging. According to Mr. Massarotti, this pond was recently <br />cleaned. The sediment level was low. The drainage inlet to the pond was stable. The primary and emergency <br />spillway was clear and functional. The embankment was observed, it does appear the sheet flow from the <br />embankment is washing sediment below the embankment.
