EXHIBIT C <br /> MINING PLAN: <br /> The Permit Boundary of this plan contains approximately 7.66 acres;the mining limits of this plan <br /> are approximately 100 feet x 300 feet, containing less than 0.69 of an acre. It will be situated on <br /> the westerly side of a 35 acre parcel (La Plata County GIS Parcel No. 5657-263-00-087) and is <br /> owned by Luke the Duke LLC. This 35 acre tract is located in the NE1/4SW1/4 of Section 26, <br /> Township 35 North,Range 11 West,New Mexico Principal Meridian,La Plata County,Colorado. <br /> The current address is 787 County Road 120. <br /> Two previous pits on site have been excavated and are being processed through the Reclamation <br /> Plan of the this application <br /> Mining on the proposed pit will commence on July 1,2014 and end on July 1,2017.The affected <br /> land is to be used for less than one hundred eighty days per year. <br /> The top 24" of soil will be salvaged and stock piled for the use in the Reclamation process. The <br /> pile will be stabilized with the planting of native grasses.There is approximately 18"of overburden <br /> to be removed and will be used for landscaping purposes within Avery Ranch, Horseman's Park, <br /> Cross Creek Ranch,the Highlands at Cross Creek Ranch and the Preserve and will not be stored <br /> on site. The thickness of the gravel to be mined is approximately 10 feet. <br /> Access to the pit site is via an existing private road known as Equestrian Trail located on the <br /> northerly boundary of the parcel. Equestrian Trail was created and dedicated to Luke the Duke, <br /> LLC by the Horseman's Park plat recorded under Reception No. 935901 and the Amended Cross <br /> Creek Ranch Plat recorded under Reception No. 901629. All travel from the site will be from the <br /> entrance west to Cross Creek Road.Access to County Road 120 is not allowed or being proposed. <br /> There are no office, shop/maintenance buildings, plant, processing facilities, or any underground <br /> openings, such as adits or ventilation facilities existing on site and none are being proposed. <br /> There is one 40'x120' topsoil stockpile area located in the southwesterly corner of the Permit <br /> Boundary.Topsoil will be used in the Reclamation of the pit after extraction.There are two Gravel <br /> stockpile areas,one with a 40' radius and one with a 60' radius both located north and west of the <br /> topsoil stockpile area. <br /> All roads used in the mining operation are existing. The average width of the roads is <br /> approximately 24 feet. All roadways located in Avery Ranch, Horseman's Park, Cross Creek <br /> Ranch, the Highlands at Cross Creek Ranch and the Preserve were dedicated to Luke the Duke, <br /> LLC for the purpose of ingress and egress during the platting process of each subdivision. <br /> No water use is being proposed in conjunction with the operation and no ground water has been <br /> evident during the previous excavations. <br />
