Lessee shall have the right to use the Premises for any purpose not otherwise <br /> prohibited by the.laws of the County of Grand, State of Colorado, including but <br /> not limited to the exclusive right to develop, excavate, process, stockpile, remove <br /> and sell sand, gravel and rock, and related businesses such as cement and asphalt <br /> plants; <br /> b. Lessee shall have the right to engage whatever type of machinery and processing <br /> it deems necessary and advisable for its activities on the Premises; <br /> C. Lessee shall have the right to erect such buildings and structures it deems pertinent <br /> and complimentary to its activities on the Premises; <br /> d. Lessee shall have the right to sublease or subcontract any of the uses granted <br /> under the Grand County Special Use Permit. <br /> 7. Taxes: <br /> a. Lessee shall pay all improvement taxes and gravel production taxes assessed, that <br /> are a direct result of Lessee's operations on the Premises; <br /> b. Lessor shall pay for all ad valorem real estate taxes on the Premises that do not <br /> include the above improvement taxes; <br /> F_ C. Lessee shall pay for any personal property taxes on equipment or inventory located <br /> on the Premises. <br /> 8. Permits: <br /> Lessee shall obtain and pay for proper permits necessary for mining and any other <br /> activities on the Premises, and secure reclamation bonds as required by law. <br /> 9. Insurance: <br /> Lessee shall keep in force and provide Lessor with a Certificate of Insurance of Worker's <br /> Compensation and Employers' Liability Comprehensive General Liability. Lessor shall be an <br /> additional insured; <br /> 10. Indemnification: <br /> Lessee expressly binds itself to defend, indemnify and hold harmless the Lessor against <br /> any and all liability loss or damage brought about by Lessee's use of the Premises by any person <br /> or party. <br /> 11. Right of Inspection: <br /> Lessor may access the Premises at any time for purposes of inspection or verification of <br /> work in progress.
