OPERATORS <br /> SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br /> WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br /> Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br /> Reclamation Board will consider possible enforcement action. <br /> INSPECTION TOPIC: Financial Warranty <br /> PROBLEM/POSSIBLE VIOLATION: Problem: The financial warranty for the process area is not adequate to <br /> reclaim the site in accordance with the approved reclamation plan (rangeland). This is a failure to maintain the <br /> proper financial warranty amount to complete reclamation of the affected lands pursuant to C.R.S. 34-32.5- <br /> 117(4)(b) of the Act. The operator will also need to confirm that the exposed surface water on site has been <br /> accounted for by the committing of adequate water rights to the State Engineer's Office. <br /> CORRECTIVE ACTIONS:The operator shall submit a new financial warranty estimate for the removal of all <br /> structures in the process area to be reviewed/approved by the Division. The operator may also choose to notify <br /> DRMS that they wish to submit a permit amendment to change the post-mining land use to <br /> "industrial/commercial" if such a change would still comply with local land use requirements. If the change to <br /> post mining land use is approved through the amendment process a bond increase for the process area may not <br /> be required <br /> CORRECTIVE ACTION DUE DATE: 8/29/14 <br /> INSPECTION TOPIC: Off-site Damage <br /> PROBLEM/POSSIBLE VIOLATION: Problem: Land has been affected outside of the approved permit boundary. <br /> Specifically, a product stockpile in the process area has been allowed to expand past the western permit <br /> boundary. This is a possible violation at this time pursuant to: C.R.S. 34-32.5-116(4)(i) for failure to protect <br /> areas outside of the affected land from slides or damages occurring during the mining operation. <br /> CORRECTIVE ACTIONS: DRMS will allow the operator until August 29, 2014 to move the stockpile material back <br /> fully into the permit area, clearly mark the permit boundary, and reclaim all area impacted by this activity. If <br /> this has not been completed and documentation submitted to DRMS to verify the corrective action by the <br /> Page 1 of 4 <br />
