Bird, GCC Energy, LLC18Jul 2014 <br />Page 2of 3 <br />C-1981-035CMWB InspectionAdeqReview <br />4.09DISPOSAL OF EXCESS SPOIL <br />4.09.1 General Requirements <br />(11)Inspection <br />(a)The fill shall be inspected for stability by a registered engineeror other qualified <br />professional specialistexperienced in construction of earth and rockfill embankments <br />under the direction of a qualified professional engineer at least quarterlythroughout <br />the construction and during the following critical construction periods: (1)removal of <br />all organic material and topsoil, (2)placement of underdrainage systems, (3) <br />installation of surface drainage systems, (4)placement and compaction of fill <br />materials, and (5) revegetation. <br />(b)The qualified registered engineer shall provide to the Division a certified report within <br />2 weeks after each inspectionthat the fill has been constructed as specified in the <br />design approved by the Division. The report shall include a description of any appear- <br />ances of instability, structural weakness, and other hazardous conditionsobserved <br />during the inspection. A copy of the report shall be retained at the mine site. <br />(c)Any certified report addressing the underdrain system and protective filters shall <br />include color photographs taken during and after construction, but before underdrains <br />are covered with excess spoil. If the underdrain system is constructed in phases, each <br />phase shall be certified separately. Where excess durable rock spoil is placed in single <br />or multiple lifts such that the underdrain system is constructed simultaneously with <br />excess spoil placement by natural segregation of dumped materials, photographs shall <br />be taken of the underdrain as the underdrain system is being formed. The color <br />photographs accompanying each certified report shall be taken in adequate size and <br />number with enough terrain or other physical features of the site shown to provide a <br />relative scale to the photographs and to specifically and clearly identify the site. <br />4.10COAL MINE WASTE BANKS <br />4.10.2 Site Inspection <br />(1)All coal mine waste banks shall be inspected, on behalf of the person conducting surface <br />coal mining operations by a qualified registered engineer, or other qualified professional <br />specialist under the direction of the professional engineer, experienced in construction of <br />similar earth and waste structures, approved by the Division. <br />(2)Inspection of coal mine waste banks shall be performed in accordance with rule 4.09.1(11), <br />and the following additional requirements: <br />(a)Inspection shall occur at least quarterly, beginning within 7 days after the preparation <br />of the disposal area begins. The Division may require more frequent inspection based <br />upon an evaluation of the potential danger to the health or safety of the public and the <br />potential harm to land, airand water resources.
