Revised Map 29 does not depict the cross - sections that are discussed in this section of the <br />permit and the contour lines do not show adequate detail to depict the post mine <br />topography. Also, the legend does not cover all the symbols used to depict features on the <br />map. Please see the adequacy review section Rule 2.05.4 — Reclamation Plan above, <br />specifically Item #1. <br />ii. This revised section indicates the No. 9 portal and the No. 5 portal areas have been <br />reclaimed, however the volumes to be backfilled for these areas reported on revised Table <br />63 have not changed from the currently approved Table. It does not appear these volume <br />account for the reclamation that occurred. Please clarify this discrepancy and make the <br />appropriate revisions to Table 63. <br />Response: Please refer to previous response relative to Map 29. Table 63 has been revised to clarify that <br />backfilling of certain areas has been completed, and noted the corresponding volumes, and the revised table is <br />included with these responses. <br />16 Permit page 2.05 -29 includes a discussion of the "No. 9 Coal Refuse Disposal Site ". This section describes the <br />design, construction, maintenance and reclamation of the No. 9 Mine refuse pile. The Mine No. 9 Portal refuse <br />pile was reclaimed in the summer of 2009. Please update the No. 9 Coal Refuse Disposal Site section of the <br />permit on page 2.05 -29 to include a discussion of the reclamation of the refuse pile. Please leave the design, <br />construction and maintenance portions in the section for historic purposes but the reclamation portion of <br />the section will need to be updated with the actual reclamation that was completed on the Mine No. 9 Portal <br />refuse pile. <br />a. Response: This comment essentially duplicates the previous Comment 11. Please refer to the <br />response to Comment 11. <br />b. DRMS Response: This item is resolved. <br />17. Permit page 2.05 -29 contains a section titled "Solid Waste Disposal Facility". This section details the recently <br />permitted solid waste disposal facility that was used.for demolition debris during the reclamation conducted in <br />2008 (TR -34). During the 2008 reclamation a hole was dug for the demolition debris. After the demolition <br />was completed, MCM covered the hole, replaced topsoil and seeded the disturbance. Since that time, MCM <br />has dug another small dozer slot in the solid waste disposal area for the ongoing disposal of mine - related <br />waste materials. While the Division believes that this dozer slot is within the scope of the permitted solid waste <br />disposal facility, there is no mention, specifically, of this practice. Please amend the text on permit page 2.05- <br />29 which relates to the Solid Waste Disposal Facility. Please include a description of the dozer slot(s) that is <br />currently being used for the disposal of mine - related materials. Please include a reclamation plan for the <br />dozer slot and any subsequent dozer slots that MCM digs. Please also include a list of the types of materials <br />that MCM will be placing in the dozer slot. <br />a. MCM Response: The specific Permit text discussion addressing the Solid Waste Disposal Facility <br />has been reviewed and revised to include information on ongoing use and reclamation relative to <br />the referenced dozer slot. Copies of the revised Permit discussion accompany these responses for <br />replacement in the PAP. <br />b. DRMS Response: This item is resolved. <br />18. Permit page 2.05 -31 contains a discussion of the "No. 5 and No. 6 Mine -Water Handling System". Please <br />review the information contained in this section for completeness and accuracy since MCM is replacing the <br />Mine No. 5 dewatering pump. <br />a. Beginning on permit page 2.05 -31.1, MCM discusses some of the individual areas of the mine that will be <br />reclaimed. With the reclamation that was performed in 2008, 2009 and 2010, the status of some of these areas <br />has changed.
