It-- <br />Mr. Michael Boulay <br />Ju�y 15, 2014 <br />Page 3 <br />Inspection Report Page 4 Paragraph I "One segment (Segment 5 located west of the entrance to <br />the facilities area, Photograph No. 8) had a geotextile liner that was not a part of the as -built <br />documentation..." <br />o At the time of the as -built this section did not have the geotextile line installed. This was <br />installed as a maintenance item to prevent erosion taking place near the water stand. The <br />piping and valves of the water supply line feeding the water stand were leaking and <br />creating some stability issues around the ditch and water stand area. The liner was <br />installed in the summer of 2013 to protect the channel in this area. Tri -State believes <br />that the use of this type of material for erosion control is allowed under the permit. Tri - <br />State is fully committed to modeling the above mentioned liner as part of the technical <br />revision that will be submitted to the Division. <br />In summary, while Tri -State believes that the as -built documentation approved by the Division <br />under TR -04 accurately depicts the constructed condition of both ditches, the as -built documentation <br />should have been more clearly defined to completely document as -built conditions. <br />Tri -State is requesting an assessment conference to further discuss this NOV. Tri -State is fully <br />committed to abating this NOV within the timeframes listed in the NOV, and will work with the Division <br />in any manner necessary to correct the issues identified in an expedient manner.
