Bill Bear of <br />Bowie Resources, LLC (BRL) was present during the inspection. Weather conditions at the time of the inspection <br />were clear, hot, and dry; ground conditions were dry. <br />Longwall mining was underway in Panel 15; a train was scheduled to be loaded the morning following the <br />inspection. No refuse was being hauled during the inspection. <br />AIR RESOURCE PROTECTION Rule 4.17: <br />Roads were being watered during the inspection. No fugitive dust was seen emanating from the roadways or <br />equipment working areas. <br />HYDROLOGIC BALANCE - Rule 4.05Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, <br />4.05.6; Discharge Structures 4.05.7, 4.05.10; Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water <br />Monitoring 4.05.13; Surface Water Monitoring 4.05.13; Drainage Acid and Toxic Materials 4.05.8; <br />Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />Ponds B, C, D, F, and J all held water; Pond K was dry. No water was being discharged off -site from any of the <br />ponds. <br />• Pond B was being cleaned out; material excavated from the pond was trucked to Gob Pile 43 and placed on <br />the northeastern portion of the pile. <br />• Pond C was being discharged to Pond D; the water leaving Pond C appeared to be clear. Pond C had not yet <br />been cleaned. The operator indicated that it would be cleaned after Ponds B and F were completed. <br />• Pond D had been recently cleaned out, and was in good condition. <br />• Pond F had been dewatered to allow it to dry out for cleaning. Some material had been pulled out of the west <br />inlet end of the pond, but it did not appear that any mucking in the main cell had been done. <br />Pond J is not scheduled to be cleaned this season, nor did it appear to be necessary. <br />Ditch J8 had been regraded recently, but the low gradient of the ditch just before it enters culvert J8 is causing <br />water to pool.
