OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br />Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br />Reclamation Board will consider possible enforcement action. <br />INSPECTION TOPIC: Availability Of Records <br />PROBLEM /POSSIBLE VIOLATION: Problem: The Permanent Man -made Structures agreement with Centel for <br />the power line running through the permit boundary is deficient and the Division has reason to believe is out of <br />date. <br />CORRECTIVE ACTIONS: The Operator, by July15, 2014 must either: (a) provide a notarized agreement between <br />the Operator and the owner of the power line, that the Operator is to provide compensation for any damage to <br />the structure; or (b) where such an agreement cannot be reached, the Operator shall provide an appropriate <br />engineering evaluation that demonstrates that such structure shall not be damaged by activities occurring at <br />the mining operation; or. (c) as the structure is a utility, the Operator may supply a notarized letter, on utility <br />letterhead, from the owner(s) of the power line that the mining and reclamation activities, as proposed, will <br />have "no negative effect" on their utility. <br />CORRECTIVE ACTION DUE DATE: 7/15/14 <br />INSPECTION TOPIC: Roads <br />PROBLEM /POSSIBLE VIOLATION: Problem: There is a significant collapse in the southern access ramp rising <br />from the pit floor to the overburden /topsoil stockpile above the highwall that presents a potential safety <br />hazard. <br />CORRECTIVE ACTIONS: The Operator shall complete repairs to the access road in order to stabilize the road and <br />provide documentation of these repairs to the Division by the due date. <br />CORRECTIVE ACTION DUE DATE: 7/30/14 <br />INSPECTION TOPIC: Revegetation <br />PROBLEM /POSSIBLE VIOLATION: Problem: Tamarisk (salt cedar) trees are present within or have volunteered <br />Page 1 of 8 <br />
