Exhibit 15 to include a commitment to install subsidence warning signage on
Stevens Gulch Road where the road passes through the affected area.
BRL - Exhibit 15, page 46 was amended to state specifically warning signs will be
placed on Stevens Gulch Road.
43. DBMS - The double mining horizon has been removed from Figure 15 -3, presumably
because BRL is not contemplating double seam mining for the remainder of the permit
term. This line, however, should be retained for comparison to the predicted maximum
subsidence to the actual subsidence in previously mined areas. Please restore the double
mining horizon line to Figure 15 -3.
BRL - Figure 15 -3 was revised to show the double mining horizon.
Rule 2.10 - Maps and Plans
44. DRMS - The projected B Seam mining shown on Maps 10A and 10B does not include the
panels proposed under PR -14 (Panels 17 -28), nor has it been updated to show the
currently completed B Seam workings. Please update Maps 1 O and 1 O to include all B
seam mining proposed under PR -14 and indicate the completed workings to date, with
the correct orientation of B Seam Panels 15 and 16.
BRL - Enclosed are updated Maps 10A and 10B.
45. DRMS - Please revise Map 27 to include a numbering system and legend (similar to
the system used on Map 23 for water rights) to depict the location and a description of
all structures and renewable resource lands within the permit and adjacent area, as
required by Rule 2.O5.6(6)(a)(ii)(B).
BRL - A numbering system was added to Map 27 to show structures and some of the
renewable resource lands. Under 2.05.6(6)(a)(ii)(B) the permit application states: The
creeks, ponds, springs, reservoir, access roads, trails, aqueduct, and power line alignment
are shown on Map 9, Hydrologic Monitoring Location. The location of the water rights are
presented on Map 23, Water Rights Location. The location of the water bearing zones are
presented on Maps 10A, 10B and 11. Structures are shown on Map 27B.
46. DRMS - Map 27B does not show all of the West Fork of Terror Creek or the full extent of
Stevens Gulch Road in the PR -14 expansion area. Please update the map to show the
entire length of the West Fork of Terror Creek and Stevens Gulch Road.
BRL - Map 27B was updated as requested.
