Diversion Ditches <br />Second Adequacy Review <br />Dear Mr. Bear: <br />The Division has reviewed the response submitted by J.E. Stover and Associates, Inc. on behalf <br />of Bowie Resources, LLC (BRL) to the Division's preliminary adequacy review letter for Technical <br />Revision No. 87 (TR -87) for the Bowie No. 2 Mine. The revision proposes to expand Pond D. <br />The revision initially also included plans to relocate the East and West Diversion ditches of Gob <br />Pile #2; BRL submitted TR -89 for relocation of these diversions, instead. We have the following <br />comments and questions regarding BRL's response. <br />1. BRL provided additional information to address comments received from the Division of Water <br />Resources. <br />a. The text on revised page 2.05 -40 states that "(d)ewatering events should occur within 72 <br />hours after the storm event..." In order to comply with the State Engineer's current policy <br />requiring that all impounded water be released within 72 hours of impoundment, please <br />revise the text on page 2.05 -40 to affirm that dewatering will occur within 72 hours by <br />replacing the word "should" with "will" or "must ". <br />b. BRL's response letter indicated that evaporative loss in Pond D would not be increased <br />because the pond would be terraced to expand the capacity. It is the Division's <br />understanding that the increased surface area will result in increased evaporative loss. BRL <br />has since contacted the Division of Water Resources for clarification on this matter. Once <br />we have clarification, we will determine how to proceed. <br />2. BRL indicated that Form 1403 would be submitted to History Colorado as soon as it is <br />complete.
