6.4.8 EXHIBIT H-Wildlife Information <br /> 2) We have been discussing salvaging the fish in the lake with Colorado Parks and Wildlife <br /> (CPW) since February of this year. See attached email from Paul Winkle (CPW). They want to <br /> remove the fish before we proceed with the filling operation. The Authority will coordinate this <br /> effort directly with CPW. <br /> 3) We engaged the services of a consultant (URS) to perform a wildlife survey of the subject <br /> area and enclose a copy of their draft report dated June 26, 2014. Page 7 of their report says that <br /> "No state or federally listed species were observed during field surveys." <br /> 6.4.14 EXHIBIT N-Source of Legal Right to Enter <br /> 4) The Authority is the landowner of the subject permit area. Please see attached title <br /> documentation relating to the Authority's purchase of the various property parcels in the late <br /> 1990's. I have also included our aerial right of way plan sheet AER-058-PLAN that shows the <br /> parcels relative to the 2014 permit boundary. The entire permitted area is hatched yellow which <br /> is classified in the legend as "E-470 Remnant". This means that we own the property even <br /> though it is not within the actual highway footprint. We had to purchase some entire properties <br /> because the land that would have remained would not have been economically viable for the <br /> original landowner. <br /> 6.4.19 EXHIBIT S-Permanent Man-made Structures <br /> 5)I enclose the following information in relation to permanent man-made structures: <br /> a. A copy of the executed Structure Agreement with United Water and Sanitation <br /> District addressing the perimeter slurry wall of their water storage facility. <br /> b.A copy of the executed Structure Agreement with Adams County addressing their part <br /> ownership of adjacent Nome Street. <br /> c. A copy of certified mail receipts sent in March 2014 to CDOT (owners of adjacent <br /> US-85) and the Sampson Family (owners of the property located at 12155 E 132nd <br /> Ave., Brighton CO 80601).Neither of these property owners responded to our letters <br /> asking them to sign the Structure Agreements. <br /> d. A P.E. stamped letter assessing the risk to the two properties in c. above and <br /> concluding that the lake filling operation poses very little risk to either property and <br /> no more action is proposed. The Sampson Family property is located on the north <br /> side of E-470 approx. 600' from the edge of the lake. The edge of the US-85 <br /> pavement is approx. 150' from the edge of the lake. <br /> General Comments and Questions <br /> 6) The amended permit boundary is close to the boundary of our property. I have reviewed the <br /> Brannan permit documents on your web-site and any maps I could find are shown with the (now <br /> removed) old Nome Street. Based on this information, it appears that the amended permit <br /> boundary is close to the border of the Brannan permit boundary. In addition, our revised permit <br /> boundary does include all the areas of disturbance proposed by our reclamation plan including <br /> the box culvert under old Nome Street. <br /> C123-REV 0/2013 <br />
