June 3, 2014 C- 2010- 089/New Horizon North Mine MPB <br />Ditch segments. For segments that were earthen or armored, the geometry of the channel was more trapezoidal in <br />the West Ditches with a flat bottom as opposed to triangular (this conflicts with as -built documentation). The as- <br />built information reports widths that range from 3' to 17' which also conflicts with what was present on the <br />ground. One section (Segment 5 located west of the entrance to the facilities area, Photograph No 8) had a <br />geotextile liner that was not part of the as -built documentation (see Photograph No 5). Portions of the East Ditch <br />segments have failed (see Photographs 6 and 7). In several locations along the East Ditch there were isolated <br />sections that were breached on the disturbance side (no off -site impact) or the gravel material eroded away <br />exposing the Geoweb. These segments will require repair and maintenance with proper construction, and accurate <br />as -built documentation provided in a technical revision to the PAP. <br />GENERAL MINE PLAN COMPLIANCE: <br />At the time of the inspection, WFC was not informed that a violation had occurred. Upon further review by the <br />OSM and the DRMS, DRMS concludes that a violation of permit conditions has occurred and a notice of violation <br />will be issued. As described in this report under Hydrologic Balance and in Section IV Enforcement <br />Actions /Compliance, a violation will be issued for failure to conduct all surface coal mining and reclamation <br />operations only as described in the approved application [Rule 2.07.7(7)]. <br />SIGNS AND MARKERS — Rule 4.02: <br />The mine identification sign at the main entrance to the site is properly displayed. Signs and markers were in <br />place and properly maintained throughout the site with exception of the two large topsoil piles located on -site. <br />One topsoil marker is in place on the west side of the two large piles (Photograph No 8). Progresso soil is stored <br />in the north pile and REC and other soils are placed in the south pile. Each of these piles should have a topsoil <br />marker placed on the east side of each pile, respectively. WFC agreed to installing the placing the additional <br />topsoil markers. <br />TOPSOIL — Rule 4.06 <br />Removal 4.06.2, Substitute Materials 4.06.4(4); Storage and Protection 4.063; Redistribution 4.06.4: <br />The two large topsoil piles located on -site (progresso soils in the north pile and mixed soils in the south pile) are <br />bermed but lack vegetative cover. The vegetation is sparse particularly on the progresso soil pile (see Photograph <br />No 9). Section 2.05.4(2)(d) of the approved PAP provides specifics as to planting vegetation on stockpiles that <br />have been created during the summer months i.e., warm season annual grains that perform well in dry conditions. <br />To ensure compliance, please reseed the topsoil stockpiles in accordance with the permit conditions as stated on <br />page 19 of Section 2.05.4(2)(d) of the PAP. <br />DOCUMENTS RECEIVED None <br />OTHER (SPECIFY) <br />Number of Partial Inspection this Fiscal Year: 8 <br />Number of Complete Inspections this Fiscal Year: 4 <br />Page 4 of 9 <br />
