Spencer Shumate and Tom Medlin from the <br />Office of Surface Mining (OSM) conducted a complete oversight inspection. Mr. Frank Ferris representing <br />Western Fuels- Colorado accompanied us throughout the entire inspection. Weather conditions were sunny and <br />warm and ground conditions were dry at the site. Coal was being loaded and hauled from the active pit area at the <br />time of the inspection. <br />AIR RESOURCE PROTECTION — Rule 4.17: <br />Adequate dust suppression is maintained throughout the site. A water truck was watering roads for dust <br />suppression. Also observed was a crew collecting samples of the road surface to be measured for percent moisture <br />content to demonstrate compliance with the Air Quality Permit (see attached Photograph No 1). <br />AVAILABILITY OF RECORDS — Rule 5.02.4(1): <br />The availability of records was checked on the afternoon of 6/3. All required records were on file and available <br />for review at the NHN mine office. No problems were noted with the records review. See the attached <br />Availability of Records checklist at the end of this inspection report. <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.053; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10; <br />Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13; <br />Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />Sedimentation Pond NHN -001 was inspected. The pond is containing a significant amount of water, more than I <br />have observed in the past due to recent storm events. Some rills are forming on the inner side slopes of the pond <br />due to the lack of vegetation and the native material that the pond was constructed in is conducive to erosion.
