The referenced owners are not <br />identified on referenced Map 2.03.4 -M2. In addition, the referenced oil, gas, and other mineral <br />owners are not reflected on Map 2.03.4 -M3. Please revise the text page list of owners or the <br />referenced maps to delineate the current owners of record. <br />4. Per Rule 2.03.4(6) Each application shall contain the names and addresses of every legal or <br />equitable owner of record of property t be mined and areas to be affected by surface operations <br />and the names and addresses of the owners of record of all surface and subsurface areas <br />contiguous to any part of the proposed permit area. Proposed pages 2.03 -12, 12A, 13, 14 and 2.03- <br />15 list only the names of the owners. Please revise the above pages to include the addresses of <br />the owners per Rule 2.03.4(6). <br />5. Proposed pages 2.03 -16, 2.03 -18, and approved page 2.03 -17 does not include information <br />discussing the Right to Enter NRC -CO, LLC or Betsy L. Sanger et al. In addition, no information was <br />provided concerning right to enter surface within the permit area to include: Cross Mountain <br />Ranch, Public Service of Colorado, Wilton Earl and Sons, Diamond T Sheep, Camilletti and Sons, <br />Hallenbeck and Zulian. Per Rule 2.03.6, please submit documents upon which the applicant <br />claims right to enter. <br />6. Proposed Map 2.04.3 M1 Land Use, identifies various outlined areas. This Map does not include <br />information in the form of a map legend or labels to delineate the outlined areas. Please revise <br />the proposed Map 2.04.3 M1 to identify all required information. <br />Per Rule 2.04.4, a description of the cultural and historical resources listed or eligible within all <br />areas proposed or likely to be affected by surface activities or planned or probable subsidence over <br />the life of the mine is required. Proposed Map 2.04.4 M1 omits portions of cultural surveys <br />conductes in the areas of proposed subsidence. Please provide information on the areas within <br />planned subsidence which have not received a cultural and historical survey or provide <br />information discussing the reason a survey is not required in the areas of planned subsidence. <br />8. Approved exhibit 2.04.4 -E1 identifies four cultural and historical sites as eligible and eight sites <br />that "need data ". Eligible sites are identified as 5RT519, 5RT1368, 5RT1369, and 5RT1370. Need <br />data sites are identified as 5RT20, 5RT22, 5RT139, 5RT512, 5RT2737, 5RT2739, 5RT2741, and <br />5RT2745.
