Jessica Loveland, representing Mountain Coal, LLC, accompanied me on the <br />inspection. West Elk was actively mining during the inspection while no coal was being shipped at the time. The <br />weather was warm and clear with surficial ground conditions mostly dry. <br />FISH and WILDLIFE — Rule 4.18: <br />Around six deer were located in the mine facility area resting along the shaded area of the mine buildings. <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10; <br />Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13; <br />Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />Mine representative Jessica Loveland stated that West Elk Mine lined their ditch channels with non - erodible rip <br />rap to help prevent sediment build up and erosion within the previous year. Visual inspection of the ditch lines <br />throughout the Sylvester Gulch facility area shows no major signs of cutting with minimal sediment build up <br />within the ditches. Additionally, no issues were observed with any ditches inspected throughout the rest of the <br />mine site. <br />Mine water treatment ponds were inspected. Ponds held water at the time of inspection with no discharge. Ponds <br />were lined with an impermeable fabric. No issues were observed with the mine water treatment ponds. <br />Sediment pond SG -1 was inspected and held water. The primary discharge inlet was submerged within the pond <br />water but was not discharging. Emergency spillway was stable with rip rap and vegetation.
