3.1.6 Water — General Requirements: <br />(1) Hydrology and Water Quality: <br />Disturbances to the prevailing hydrologic balance shall be minimized: <br />(a) Compliance with applicable Colorado Water laws and regulations <br />governing injury to existing water rights: <br />No surface or other tributary water will be impacted. Potable water will be hauled <br />to the site in five gallon or smaller containers. We do not anticipate operational <br />water needs for dust control since minimal surface areas will be impacted, no <br />rotary core drill will occur, and vehicle speeds will be less than 10 mph when on <br />the waste dump areas. Since the sampled areas are above the ground water table <br />and the samples will be dry, there should be no significant evaporative losses <br />associated with this operation. <br />(b) Compliance with applicable federal and Colorado water quality laws <br />and regulations, including statewide water quality standards and site <br />specific classifications and standards adopted by the Water Quality <br />Control Commission: <br />New West Reclamation, LLC will obtain a Stormwater permit from the Water <br />Quality Control Division. We will maintain compliance with the terms and <br />conditions of the Stormwater permit. <br />(c) Compliance with applicable federal and Colorado dredge and fill <br />requirements: <br />No wetlands will be affected by the proposed exploration operations. <br />(d) Removing temporary or large siltation structures form drainageways <br />after disturbed areas are revegetated and stabilized, if required by the <br />Reclamation Plan: <br />No temporary or large siltation structures are associated with the proposed <br />exploration operations. <br />(2) Earth dams, if necessary to impound water, may be constructed if the <br />formation of such impoundments will not damage adjoining property or conflict <br />with water pollution laws, rules or regulations of the federal government, the state <br />of Colorado or with any local government pollution ordinances: <br />No new earthen dams will be constructed. <br />13 <br />
