(8) If the Operator's choice of reclamation is for agricultural or horticultural <br />crops which normally require the use of farm equipment, the Operator shall <br />grade so that the area can be traversed with farm machinery: <br />Not applicable to this operation. <br />(9) An Operator may backfill structural fill material generated within the <br />MLRB permitted area into an excavated pit within the permit area as provided for <br />in the MLRB Permit. If an Operator intends to backfill inert structural fill <br />generated outside of the approved permit area, it is the Operator's responsibility to <br />provide the Office notice of any proposed backfill activity not identified in the <br />approved Reclamation Plan in accordance with the provision of Section 3.1.5(9): <br />No structural fill will be imported. <br />(10) All mined material to be disposed of within the affected area must be <br />handled in such a manner so as to prevent any unauthorized release of <br />pollutants to the surface drainage system: <br />Some small amounts of material will be placed on the surface during excavation to obtain <br />samples at various depths. A tarp, heavy plastic or other similar material will be placed <br />next to a sampled site for placement of excavated material. (Note: Auger holes will not <br />be conducive to the use of a tarp. The auger hole would need to be drilled through the <br />tarp and would likely get tangled up in the mechanism.) Once samples are obtained, the <br />excavated hole will be filled with the excavated material. Our Stormwater Management <br />Plan will be implemented at each sample site to prevent any unauthorized release of <br />pollutants to the surface drainage system. <br />(The exception to concurrent sample site reclamation will be sampling completed during <br />winter or snowfall months. During the winter sampling, we will complete what <br />back filling and other sample site reclamation is logical to complete, given site specific <br />conditions. The winter sampled sites will be checked in the spring, after snow melt, for <br />implementation of any corrective actions necessary to stabilize the site.) <br />(11) No unauthorized release of pollutants to ground water shall occur from any <br />materials mined, handled or disposed of within the permit area: <br />The release of pollutants to ground water from sampling activities will not occur. No <br />ground water will be intercepted during exploration operations. The sampling operations <br />are intended to sample down to the original ground surface beneath a waste dump. <br />Therefore, no ground water systems will be impacted. <br />12 <br />
