The County shall remove these <br /> stockpiles from Owner's Land and reclaim areas disturbed by the stockpiles. <br /> H. Fencing. The Owner shall suitably fence the reclamation area to prevent <br /> livestock grazing during critical re-vegetative periods. <br /> I, Storm Water. The County shall reasonably defend the site from storm water <br /> runoff originating from property other than the Leased Premises' by reasonable <br /> means, such as berms and dikes and maintenance of the same. <br /> J. Records. The County shall keep accurate record of all reclamation materials <br /> imported into the Leased Premises. Current technological tracking such as, load <br /> counters, loader scales or portable scales shall be employed as a means of <br /> W 3= accurate record keeping. The Owner shall have the privilege of examining the <br /> County's records and correspondence related to the Leased Premises during <br /> c ;.�� normal business hours. <br /> `a K. Surface Rights. The County has the right to clear brush and undergrowth from <br /> ��$ such portions of the Leased Premises as may be reasonably necessary to explore <br /> Cc`x for material or to locate pits quarries, and stockpile areas. <br /> m��= L. Damage to Livestock, Crops,and Improvements.The County shall repair any <br /> Ic"o damage done to water wells, drinking troughs, storage tanks and other similar <br /> N0-OW improvements on the Leased Premises. The County shall pay the reasonable <br /> mm,.�' value of any livestock or crops that may be injured, killed, destroyed or <br /> Vim_ damaged by the County or its agents. <br /> o1O q M. Protection of Leased Premises. The County shall install gates and cattle guards <br /> Nam b <br /> ��£ at all entrances into the Leased Premises used by the County. Said Gates will be <br /> o locked at night and at all times the area is not in use by the County. <br /> a,0 0_ <br /> OI aE— <br /> ia°n�� N. Separate Agreement.The terms and conditions herein are separate from, and <br /> not intended to limit, any conditions or requirements imposed by the MLRB on <br /> the County. <br /> 5. Additional Rights and Obligations of the Owner <br /> A. Property Taxes. Owner shall pay all taxes assessed or that may be assessed <br /> against the Leased Premises promptly and before they become delinquent, <br /> including but not limited to real property taxes and severance taxes. <br /> 6. Claims from the County's Past Mining Activities on the Owner's Property. <br /> A. Tolling Provision.The County agrees that the period commencing November 1, <br /> 2013 and ending upon termination of the Lease Agreement("Tolling Period"), <br /> will not be included in computing the running of any statute of limitations <br /> applicable to any action or claim brought by Owner for County's past mining <br /> activities on the Owner's Land, pursuant to federal, state or local law, <br /> regulations for damages, injunctive relief and any other relief in connection with <br />
