The annual Lease payment shall include the right to use soil <br /> and gravel material existing in the Leased Premises for purposes of reclamation and to <br /> achieve desired slope, at no additional cost to the County. <br /> 3. Term. This lease shall terminate ten (10)years from the date of mutual execution. If <br /> the MLRB has not released the County at the end of the 10 year term, the County may <br /> extend the term of the Lease for additional one year increments for up to five (5) <br /> additional years on the same terms, except the annual Lease payments shall be double <br /> the amount specified in paragraph 2. <br /> 4. Additional Rights and Obligations of the County. <br /> A. Reclamation. The County shall reclaim the Leased Premises in accordance with <br /> the requirements set forth in the 2002 Permit and other requirements in this <br /> Lease. The County shall be responsible for obtaining an amendment to the <br /> 2002 Permit consistent with this Agreement. Owner agrees to cooperate with <br /> the County on its application to amend the 2002 Permit. <br /> B. Reclamation to be completed with reasonable diligence. The County agrees to <br /> use reasonable efforts to reclaim the Leased Premises and obtain release of its <br /> reclamation responsibilities from the MLRB. <br /> C. Access. The County shall have the right to ingress and egress to the Leased <br /> Premises using the existing road shown on Exhibit A. The County agrees to close <br /> any gates that it opens. <br /> D. Limitations on Use. The County's use of the Leased Premises shall be limited to <br /> those activities reasonably necessary to obtain a release of the County's <br /> reclamation responsibilities from the MLRB. <br /> E. Slopes. The County shall grade the banks of the areas to be reclaimed to a slope <br /> no steeper than 3:1 (horizontal to vertical ratio). The County shall excavate the <br /> immediately adjacent land outside of the previously mined area (all of which <br /> shall be within the Leased Premises), and use this material at no additional cost <br /> to the County to achieve the required slope. <br /> F. Placement of topsoil. The County shall spread topsoil uniformly over the <br /> disturbed area to a packed depth of 6 inches, which shall require a minimum of <br /> 1000 yards of topsoil per disturbed acre. All topsoil imported to the Leased <br /> Premises by the County shall meet or exceed measurable criteria established by <br /> Natural Resource Conservation Service standards for topsoil prevalent in the <br /> areas contiguous to the Leased Premises. Imported soils must be free of <br /> Prohibited Noxious weeds and debris not commonly found in topsoils of the <br /> contiguous area. <br /> G. Removal of Trash and Debris.
