enter: All federal lease documents to include the currently approved lease area for all <br />holes, including any modifications of appropriate leases; lease agreements with <br />Dunn/Ute /Stephens; an approved Federal Coal Exploration Plan or Federal Coal <br />Exploration License; the surface access agreements for all holes proposed to be drilled. <br />3. Rule 2.02.2(g) - Page 3 of the document titled Federal Coal Exploration Plan identifies the <br />dominant vegetative communities' occurring within the proposed exploration area. However, a <br />revegetation seed -mix was not included in the reclamation plan submitted to the Division in <br />order to comply with 2.02.2(g). <br />Please submit a proposed seed -mix which complies with Rule 4.21.4(6) which states that in <br />all areas revegetation shall be carried out in a manner that encourages prompt vegetative <br />cover and recovery of productivity levels compatible with the approved post - exploration <br />land use. <br />4. Rule 2.02.2(h) - Page 3 of the document titled Federal Coal Exploration Plan provides an <br />overview of threatened and endangered species. <br />Please submit a statement with appropriate references from the relevant State and Federal <br />agencies which determines that the exploration and reclamation will no jeopardize the <br />continued existence of an endangered or threatened species or result in the destruction or <br />adverse modification of critical habitat of those species. <br />Determination of Proposed Activities as Coal Exploration [Regulations 2.02.2(3) and <br />1.04(22)] <br />The activities described in the NOI qualify as "coal exploration" as defined at Regulation <br />1.04(22). <br />Determination of Substantial Natural Land Surface Disturbance [Regulations 2.02.2(3) and <br />1.04(127)] <br />The coal exploration activities described will substantially disturb the natural land surface, as <br />defined at Regulation 1.04(27). <br />If you have any questions or comments please feel free to contact me. <br />Sincerely, <br />JasonD.
