Rule 2.02.2(2)(c) - Page 7 of the document titled Federal Coal Exploration Plan states that <br />GCC has included a Project Area Map in Appendix A. The referenced map in Appendix A is a <br />1:44,000 map rather than a 1:24,000 or larger map as required. In addition, the attached map <br />fails to define occupied dwellings, pipelines, proposed locations of trenches, structures to be <br />constructed, the location of land excavations to be conducted, earth or debris disposal areas, and <br />topographic and drainage features. <br />Please submit a map at a scale of 1:24,000, or larger of the exploration area, which includes <br />the referenced information identified in the application. <br />2. Rule 2.02.2(2)(e) - Page 7 of the document titled Federal Coal Exploration Plan states that <br />GCC will submit all surface access agreements required to conduct the proposed exploration <br />activities prior to regulatory approval of the coal exploration plan. Page 8 of the referenced <br />document identifies the Ute Mountain Ute Indian Tribe as the single surface owner for the <br />proposed exploration area and Federal and Dunn/Ute /Stephens as the mineral owners for the <br />proposed exploration area. <br />Please submit copies of the following to provide basis upon which GCC claims right to <br />1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http: / /mining.state.co.us <br />John W.
