The Office of Surface Mining Reclamation and Enforcement (OSMRE), represented by <br />Spencer Shumate and Jeremy Spangler, conducted oversight of the inspection as a special focus inspection for the <br />2013/2014 evaluation year. The focus of the inspection was intended to evaluate coal mine waste banks, <br />particularly compliance with engineering and hydrology control requirements. Bill Bear and Gary Harding <br />(Bowie Resources, LLC (BRL)) and James Stover (J.E. Stover and Associates, Inc.) were present during the site <br />inspection. <br />Weather conditions during the inspection were partly cloudy and warm; ground conditions were dry. Coal was <br />being longwall mined in the B Seam, in Panel 15; refuse material was being placed in Gob Piles 42 and 43. <br />HYDROLOGIC BALANCE -Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10; <br />Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13; <br />Drainage —Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />Pond F held water and was being pumped to Pond C. Ponds B, C, D, and J all held water; none were being <br />pumped or discharged. Water was flowing into Pond J; no flows were observed into any other ponds. Pond K <br />was dry. <br />Dilapidated silt fence was observed in several locations throughout the permit area. Currently, drainage from <br />these areas is routed to Pond J. With approval of TR -89, many of these areas will require implementation of <br />approved methods of alternate sediment control. As discussed during the March 11, 2014 and May 9, 2014 site <br />inspections, BRL needs to review the alternative sediment control requirements in the currently approved permit <br />application package to determine which areas of silt fence are instrumental in the approved sediment control plan. <br />Required silt fence should be replaced /repaired as necessary.
