We do not believe that we <br />were compensated for their removal. <br />Response: EFCI does not owe the Appellants any further sums for coal mined from the land which <br />the Vento Trust Group now owns. <br />EFCI performed its operations in accordance with its rights under the coal leases that covered the <br />land and coal which the Trento Trust Group now owns. Royalties on all coal mined from these lands <br />was duly paid to the predecessors in interest to the Trento Trust Group. The Vento Trust Group <br />along with South Wind Land and Mining LLC, were also paid the sum of $450, 000 by EFCI under <br />the terms of a Settlement Agreement, General Release, and Covenant not to Sue that covered all <br />claims that were made or could have been made by Appellants in the litigation that preceded the <br />Settlement Agreement. <br />Item No. 7: <br />The reclamation plan was for ten years. EFCI has never been fined for not complying to that time <br />table. <br />Response: The ten year plan did not establish a maximum period of time to achieve the required <br />goals of the reclamation process. <br />Item No. 8: <br />Drill holes. Over the past year, Linda Saunders has requested a complete list of the drill holes, drill <br />core sample information and their locations from George Patterson. Our understanding is that <br />Energy Fuels will need to fill each one before final reclamation but we would appreciate having <br />them identified as soon as possible, following up on our request to Janet Binns on July 1, 2013. <br />Response: A copy of the Geology Map showing the location of the known drill holes was provided <br />to Ms. Saunders in 2012. <br />Item No. 9: <br />Subsidence: We are concerned about possible subsidence at the Vento office building and County <br />Road 93. Also it seems that County Road 15 has subsided and the Florence water line is in the <br />middle of it. These need to be addressed and remediated as soon as possible for public safety and <br />definitely before the final subsidence report which was delayed from 2012 until 2013 and it's now <br />April 2014, Reference: <br />Response: The Subsidence Report required under the permit for Southfield has been completed in <br />2014 and recorded subsidence is within the predicted limitations of the approved permit. <br />Item No. 10: <br />
