The primary focus of the inspection was to visit the proposed Spruce Stomp lease area; the refuse areas <br />and ponds were also inspected. Bill Bear of Bowie Resources, LLC (BRL) was present during the entire site <br />inspection, and Art Etter (BRL) was present during the visit to the Spruce Stomp lease area. Weather during the <br />time of the inspection was primarily rainy with intermittent snow showers, and temperatures in the low 50's. <br />Ground conditions were wet; the interior of the Spruce Stomp area was inaccessible by vehicle. <br />The mine is currently producing coal from the B seam, in Longwall Panel 15. Gob was being placed in Gob Piles <br />#2 and #3. <br />HYDROLOGIC BALANCE - Rule 4.05Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, <br />4.05.6; Discharge Structures 4.05.7, 4.05.10; Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water <br />Monitoring 4.05.13; Surface Water Monitoring 4.05.13; Drainage Acid and Toxic Materials 4.05.8; <br />Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />The operator took the inspectors to the proposed location for SW -12, the upper flume (upper of two flumes <br />proposed under Minor Revision No. 150) for collecting flow and water quality data on the West Fork of Terror <br />Creek. The SW -12 location will be located upstream of any mining related impacts in the Spruce Stomp area, and <br />installation of the flume will enable the operator to more accurately record low flow conditions on the creek. The <br />Division is currently working with Colorado Parks and Wildlife (CPW) and the US Army Corps of Engineers to <br />coordinate permitting of the flume installation. CPW has indicated that no in- stream work should occur during the <br />Cutthroat Trout spawning season, June 1 - September 1. <br />At the time of the inspection, at the proposed SW -12 location, the creek was at high flow conditions; the operator <br />estimated the flow at approximately 60 cfs.
