Peabody Sage Creek Mining, LLC <br />Page 7 <br />0514/2014 <br />seasonal water level fluctuations in response <br />to periods of precipitation or lack thereof. <br />Spoil well water levels indicate that down <br />slope highwall portions of the spoil exhibit <br />significant amounts of saturation. <br />21. Prevention of <br />CDRMS regulation <br />Underground development at the PSCM began <br />impacts to ground <br />4.05.11(2) <br />during the 2011 water year with no <br />water that <br />development work or mining being conducted <br />adversely impact <br />in the 2013 water year. Due to the premature <br />post- mining land <br />mining process, prevention of impacts to <br />use <br />groundwater cannot be determined as of the <br />date of this review. <br />22. Minimize <br />CDRMS regulation <br />The disturbance to the hydrologic balance <br />disturbance to <br />4.05.1(1) <br />within and adjacent to the permit area caused <br />hydrologic balance <br />by mining and reclamation at the PSCM is the <br />within and adjacent <br />minimum that can be expected from a <br />to the permit area <br />reclaimed surface mine at this location.
