Basil Bear, Bowie Resources, LLC
C- 1981 -0381 TR -581 AR No. 2
06- May -2014
redistribution of the pond embarkment material difficult, if not
impossible, without having an approved design in place.
b) The permit application indicates that the culvert will be removed when it
is no longer needed. Once the ponds are removed, the culvert will not be
needed.
C) Delaying removal of the culvert and reconstruction of the stream channel
would not follow contemporaneous reclamation requirements.
d) The depth of cover over the culvert pipe is shallow at some locations. We
believe it is likely that the culvert could be damaged during site grading
activities.
C) Once the ponds are removed, the regraded areas would need to be
revegetated. These areas would be re- disturbed the following year when
equipment is mobilized to remove the culvert.
Please submit a design for reconstruction of the affected segment of East Roatcap
Creek, in accordance with Rule 4.05.4. The design must he approved prior to
commencement of reclamation of Ponds W -1 and W -2.
Review and approval of this design could still be accomplished under TR -58, although
an extension may need to be requested. The Decision Date for TR -58 is currently May
2 y, 2014.
The TR -58 application is adequate with respect to the Timber Storage (R.O.M.)
sediment pond removal.
3. No response was required.
This concludes the Division's second adequacy review. Please contact me with any questions
you may have.
Sincerely,
Marcia L.
