Summary <br />The Review Process <br />The Carbon Junction Mine was originally operated by Pueblo Coal, Inc. under Permit No. C- <br />1982 -054 from the approval date of October 25, 1983 until the company became insolvent. The <br />original permit was revoked, and the bond was forfeited on July 25, 1990. Due to the failure and <br />closing of the Texas American Bank of Fort Worth, Texas, the Division was unable to collect the <br />monies required for the reclamation of the site. <br />During the legal process to obtain the reclamation bond of $931,150.00, the parent corporation of <br />Pueblo Coal, Oakridge Energy, Inc., entered into an arrangement with the State of Colorado to <br />replace the bond, and re- permit the Carbon Junction Mine under an entirely new permit. With a <br />new bond fully in place, Oakridge Energy, Inc. submitted an application to mine coal on July 30, <br />1992. The application was assigned file number C- 1992 -080 by the Division for the new Carbon <br />Junction Mine. The permit was approved on June 25, 1993 and formally issued on July 31, <br />1993. <br />The post- mining land uses originally approved for the Carbon Junction Mine were wildlife <br />habitat and cropland. In July 1996, an application (TR -05) to revise the post- mining land use <br />was submitted. The Division approved alternate post- mining land uses of industrial /commercial, <br />recreation, and residential on August 19, 1996. <br />In April 1997, the Division approved bond release application SL -01, which requested the <br />removal of 18.34 acres from the northwestern portion of the permit area. Approximately one <br />acre had been disturbed for the explosives storage area, and full bond release was granted for this <br />disturbance. <br />In June 1997, 12.17 acres of undisturbed area was removed from the western part of the permit <br />with TR -07. <br />On January 28, 1998, the Division received an application (RN -01) to renew the permit for a <br />second five -year term. The Division found the application complete on February 9, 1998. All <br />permitting issues were resolved with the exception of bond release issues regarding vegetation <br />sampling brought about by the land use change to industrial, commercial, and residential. <br />Stipulation No. 7 was attached to the permit renewal. <br />In June 2001, under TR -10, 7.87 acres of undisturbed area was transferred into the newly <br />permitted Ewing Mesa Pit No. 2 gravel permit (M- 2001 -053) <br />On March 11, 2003 the Division received an application (RN -02) to renew the permit for a third <br />five -year term. The Division issued a proposed decision to approve the renewal application on <br />May 29, 2003. <br />5 <br />
