Proposed Decision <br />The Colorado Division of Reclamation, Mining and Safety proposes to approve an application <br />for Permit Renewal No. 4 to conduct coal mining reclamation operations. <br />The application was submitted by Savage and Savage, Inc., on behalf of Oakridge Energy, Inc., <br />for the mine. This decision is based on a finding that the operations will comply with all <br />requirements of the Colorado State Program as found in the Colorado Surface Coal Mining <br />Reclamation Act, C.R.S. 34 -33 -101 et seq., and the Regulations promulgated pursuant to the Act. <br />If no request for a formal hearing is made within thirty (30) days of the first publication of the <br />issuance of this proposed decision, then this decision becomes final. Upon submittal of <br />acceptable surety by the applicant, the permit will be issued. The permit application, all <br />supporting documentation and any stipulations or conditions will become a binding part of the <br />permit. <br />Stipulation No. 7 was attached to Permit Renewal No. 1 (RN -01) in June 1998. The Division has <br />no documentation that this stipulation has been satisfied, but the Division anticipates the <br />submittal of a future Permit Revision application which will revise the alternate post- mining land <br />use approved under TR -05 in 1996. <br />STIPULATION No. 7 <br />DUE TO THE LAND USE CHANGE FROM WILDLIFE HABITAT TO INDUSTRIAL, COMMERCIAL, <br />AND RESIDENTIAL, THE MEANS OF DETERMINING THE CORRECT METHOD OF EVALUATING <br />THE REVEGETATION MIX AND SUCCESS STANDARDS WILL NEED TO BE REVISED. INCLUDE <br />IN THE REVISION ALTERNATIVES FOR DISTURBED AREA RECLAMATION IF THE PROPOSED <br />LAND USE CHANGES DO NOT TAKE PLACE WITHIN THE ALLOTTED TWO -YEAR TIMEFRAME <br />COMMENCING WHEN MINING HAS CONCLUDED. <br />Stipulation No. 10 was issued with the Division's approval of Technical Revision No. 15 (TR- <br />15) in January 2008, and was satisfied with the approval of Minor Revision No. 6 (MR -06) in <br />August 2008. <br />STIPULATION No. 10 <br />PONDS 001 AND 002 SHALL NOT BE REMOVED UNTIL AFTER THE COVER VALUES USED IN <br />THE UNIVERSAL SOIL LOSS EQUATION IN THE TR -15 SUBMITTAL HAVE BEEN VERIFIED BY <br />A) THE DIVISION'S SEPTEMBER 2008 INSPECTION, AND B) AN APPROVED MINOR <br />REVISION WHICH CONTAINS VEGETATION TRANSECT DATA COLLECTED IN SUMMER 2008. <br />All other Stipulations have been satisfied previously; no new Stipulations are attached to this <br />renewal. <br />4 <br />
