within the foundation of the disposal area away from the fill. Other requirements for <br />drainage control will be met (4.09.4(5)). <br />VIII. Coal Mine Waste Banks — Rule 4.10 <br />No coal mine waste banks were requested or approved for this mine; no processing waste <br />was generated during the mine's operation. <br />IX. Coal Mine Waste — Rule 4.11 <br />No special findings were made by the Division. <br />X. Backfilling and Grading — Rule 4.14 <br />A. The Division approved the retention of box cut spoil or initial cut spoil outside the pit <br />area since the applicant has demonstrated that such material is not required to achieve <br />approximate original contour in accordance with 4.09.1 (4.14.1(2)(d)). <br />B. The Division approved a modification of the general requirements of 4.14.2 for <br />reclamation to approximate original contour because the requirements of 4.27 for <br />steep slope mining have been met (refer to Section B. XX of this document). <br />C. The Division proposes to approve the method and design specifications for covering <br />and compacting of acid -and toxic - forming materials in order to prevent leaching into <br />surface and ground water and to insure backfill stability (4.14.3(2)). <br />XI. Revegetation — Rule 4.15 <br />A. The Division approved the use of introduced species in the reclamation seed mix. The <br />applicant has submitted information which shows that the introduced species are <br />desirable and necessary to achieve the approved post- mining land use, and are not <br />poisonous or noxious (4.15.2(3)). The seed mix is provided in Table 5 -6 of the permit. <br />B. Methods to measure herbaceous cover and production and species diversity are <br />discussed in Section 2.05.4 of the RN -04 Abridged Permit Document. These <br />techniques include use of a grass and forb seed mixture, with double the application <br />rate for areas that were hand - broadcast rather than drilled. Straw mulch was crimped <br />into the soil at the time of seeding, and noxious weeds are to be controlled throughout <br />the liability period. The Division approved of these techniques (4.15.7(1)). <br />C. Revegetation Success Criteria: The criterion for evaluation of revegetation success for <br />the approved post- mining land use is vegetation cover, subject to the applicable <br />requirements of Rules 3.03.1(3)(e) and 4.15.10. This vegetation cover must be <br />sufficient to control erosion.
