was intermingled with runoff from the disturbed area, and directed to Sediment Pond <br />No. 1. Flow from Carbon Junction Canyon was redirected to the permanent diversion <br />channel when the ponds were removed in 2008. The Division approved the use of a <br />riprap lining for the permanent diversion. The lining will provide stability in order to <br />protect fills and property and to avoid danger to public health and safety. The <br />diversion is located in Carbon Junction Canyon, and diverts flow around the <br />Previously Reclaimed Spoils Area and the former Sediment Pond No. 2. The <br />diversion discharges into a tributary to Carbon Junction Canyon. Design details are <br />found in Section 2.05.4 of the permit, while As -Built documentation is found in <br />Appendix 5 -12 (4.05.3(3)). <br />C. Stream Channel Diversions (4.05.4) <br />No diversions of ephemeral streams draining at least one square mile, or intermittent, <br />or perennial streams were proposed or approved. <br />D. Sedimentation Ponds (4.05.6) <br />Two sedimentation ponds were approved by the Division. The ponds were not located <br />in a perennial stream (4.05.6(1)(b)), and no alternative design criteria or specifications <br />were approved for use in sediment pond design and /or construction (4.05.6(11)). <br />E. Acid - forming and Toxic - forming Spoil (4.05.8) <br />Spoil from the Carbon Junction Mine was determined to not be acid - forming and <br />toxic - forming. <br />F. Surface and Ground Water Monitoring (4.05.13) <br />1. Prior to 2006, the applicant monitored the quality and level of ground water in <br />wells 17B, 94 -1, and 95 -1. The application for Technical Revision 13 <br />demonstrated that: a) the operation has minimized disturbance to the hydrologic <br />balance in the permit and adjacent areas, b) material damage to the hydrologic <br />balance outside the permit area has been prevented, and c) water rights of other <br />users have been protected. Based on this demonstration, the ground water <br />monitoring plan was deleted (4.05.13(1)). Baseline data results are discussed and <br />tabulated in appendix 4 -3 of the permit application. <br />2. The applicant will conduct monitoring of surface water in a manner approved by <br />the Division. The monitoring plan was submitted under 2.05.6(3)(b)(iv) and <br />includes the following: (4.05.13(2)). <br />a) Baseline data and results are included in Appendix 4 -3 of the permit. <br />b) Three springs, (1, 3 and 4) were monitored prior to 2006. Monitoring of <br />these springs was deleted in TR -13 based on the demonstration described in <br />the preceding discussion of ground water. <br />In <br />
