Section B - Rule 4 <br />I. Roads - Rule 4.03 <br />A. Haul Roads <br />The Division proposes to approve the retention of the haul road depicted on Map <br />Exhibit 1, 1984 Disturbance, since it is compatible with the approved post- mining land <br />use, and a request for its retention was submitted by the landowner (4.03. 1 (1)(f)(ii)). <br />B. Access Roads <br />The landowner has requested the retention of the road accessing the North Pit, as <br />depicted on the Mine Hydrology Map approved with TR -11 in 2002. Its retention is <br />compatible with the approved post mining land use of Industrial- Commercial, <br />Recreation, and Residential. Therefore the Division proposes to approve retention of <br />the access road (4.03.2(1)(g)(ii)). <br />C. Light -Use Roads <br />The Division proposes to approve the retention of the light use road constructed to <br />access Well B -10, east of the former South Pit. The road's use is compatible with the <br />approved post- mining land use, and a request for its retention was submitted by the <br />landowner (4.03.3). A light use road unrelated to mining activities was constructed by <br />the landowner in the vicinity of former Sediment Pond 2, as approved under MR -17. <br />11. Support Facilities - Rule 4.04 <br />Construction of support facilities was not predicted to affect water wells located within the <br />permit area. The pennittee is the landowner of the permit area. Therefore, the Division <br />approved those activities (4.04(6)). <br />III. Hydrologic Balance - Rule 4.05 <br />A. Water Quality Standards and Effluent Limitations (4.05.2) <br />The Division did not grant exemptions from sediment ponds and /or treatment <br />facilities. Two sediment ponds were constructed and maintained throughout the life of <br />the operations. The ponds were reclaimed in 2008 upon the applicant's making a <br />demonstration that reclaimed areas did not contribute sediment in excess of that <br />generated by undisturbed lands. <br />B. Diversions and Conveyance of Overland Flow (4.05.3) <br />The Division approved temporary diversion of the Carbon Junction channel. Flow <br />17 <br />
