Diversion Ditches <br />Preliminary Adequacy Review <br />Dear Mr. Bear: <br />The Division has reviewed the application submitted by JE Stover and Associates on behalf of <br />Bowie Resources, LLC (BRL) for Technical Revision No. 87 (TR -87) for the Bowie No. 2 Mine. The <br />revision proposes to expand Pond D and relocate the East and West Diversion ditches of Gob <br />Pile #2. The revision was submitted in advance of a proposed plan to enlarge Gob Pile #2 to <br />ensure that BRL can complete required modifications to hydrologic structures during the <br />upcoming construction season. We have the following comments and questions regarding the <br />application. <br />1. The State Engineer's current policy requires that, unless captured in priority, all impounded <br />water in an overappropriated stream basin (such as the North Fork) be released to the <br />stream system within a maximum of 72 hours after it is impounded. Please refer to the <br />comments received from the Division of Water Resources regarding PR -14 (previously <br />forwarded to you). Please update the permit section on water depletion (beginning on <br />page 2.04 -119), and verify that the current augmentation plan is sufficient for the <br />increased evaporative loss associated with the expanded surface area of Pond D, and that <br />Pond D will be dewatered within 72 hours of water being impounded or include a <br />demonstration that the current augmentation plan provides for retention of water beyond <br />72 hours. <br />2. The Division received comments from History Colorado, which were forwarded to you on April <br />22, 2014. History Colorado stated that the proposed expansion of Pond D and subsequent <br />demolition of the King Mine Coal Sales building would have an adverse effect on the National <br />Register - eligible King Mine site.
