April 23, 2014 C- 1981- 025/North Thompson Creek Mine BFB <br />same path and end at the same discharge point. The landowners (who also own and want to use the water rights), <br />capped the primary spillway (3" pipe) allowing Pond P9 to fill. They also re- directed the emergency spillway <br />ditch away from the primary discharge point and North Thompson Creek to the former Refuse pile pond on their <br />land (now used as a stock pond) beyond the permit boundary. These landowner modifications were done last <br />summer (20 131) to ensure that water was not lost to North Thompson Creek. <br />During this inspection it was observed that a hole has developed in the emergency spillway ditch and water <br />discharging from Pond P9 was flowing into the hole (photo 4). It appears that the water was flowing through a <br />hole in the outer 18" CMP pipe (photo 5). This hole in the 18" CMP was noted in the September 2012 inspection <br />report. The 3" primary spillway and the 18" surrounding CMP were removed or altered during the ditch <br />modifications last summer. It is not clear where the pipes were cut as the discharge ends of both pipes are buried <br />in the ground (photo 6). It appears that the Pond P9 discharge water is entering the 18" CMP through the hole in <br />the ditch and following the pipe to its end possibly saturating the hillside. A thorough inspection of the hillside <br />and surrounding area showed no signs of where the discharge was coming to the surface (photo 7), and the <br />Division is concerned about the stability of the hillside. <br />The Division issued a violation for: <br />Failure to maintain the Pond P9 primary and emergency discharge structures to minimize impacts to hydrological <br />balance, Rule 4.05.7, Act 34- 33- 120(2)0)(V) and Act 34- 33- 121(2)(1)(II) and, <br />Failure to properly maintain spillways and emergency spillways from a treatment facility, Rule 4.05.6(2), <br />4.05.6(4), 4.05.9(2) and Act 34- 33- 111(m)(I). <br />To abate the violation, the operator will need to: 1) Submit a complete Technical Revision with a spillway design <br />for Pond P9 in compliance with Rules 4.05.6(4) and 4.05.9(2) and 2) Re- construct the spillways for Pond P9 to <br />ensure the primary and emergency spillways are in compliance with the Rules 4.05.6(4) and 4.05.9(2). The <br />approved design found in Drawings D -2 -5 and D -4 -6, as described above, may need to be revised if the operator <br />intends to redirect the discharge into the refuse pile pond. <br />ROADS — Rule 4.03 Construction 4.03.1(3)/4.03.2(3) Drainage 4.03.1(4)/4.03.2(4) Surfacing and <br />Maintenance4.03.1(5) and (6)/4.03.2(5) and (6) Reclamation 4.03.1(7)/4.03.2(7): <br />The road had some ruts but was passable.
