<br />BACKGROIUJND
<br />Can April 6, 2013 Strong Mines submitted a Plan of Operations (Plan) for Apex Lode to keep
<br />open and maintain their historic mine with infrastructure, with complete reclamation at cessation
<br />of mining, in the Carbonate Mining District in Garfield County, Colorado.
<br />DECISION
<br />I have decided to approve the Apex Lode Project Plan with additional mitigation and monitoring.
<br />The complete list of additional rewired mitigation measures is included in the project record and
<br />ivill be incorporated into C_ne Plan. These include cessation of operations, removal of structures
<br />and equipment, recontour and revegetation of roads, and departure from approved Plan; other
<br />mitigation includes noxious weed/undesirable plant control, road use and maintenance.
<br />This action is categorically excluded from documentation in an environmental assessment or
<br />environmental impact statement. The applicable category of actions is identified in agency
<br />procedures as " short terra (one year or less) mineral, energy, or geophysical investigation and
<br />their incidental support activities, construction of less than one mile of low standard road, or use
<br />and minor repair of exilstiag roads" (36 CFR 220.6(8)).
<br />r took into account resource conditions identified in agency procedures that should be considered
<br />in determining whether extraordinary circumstances might exist:
<br />Federally lined threatened or endangered species or designated critical habitat,
<br />species proposed for Federal listing or proposed critical habitat, or Forest Service
