Each of your concerns is listed as specified in the letter. <br />Our responses are given in bold. <br />Concerns: <br />1. As required by Rule 1.6.2(d) and 1.6.5(2), please submit proof of publication in a newspaper of <br />general circulation in the locality of the proposed mining operation. <br />Attached is the Proof of Publication from the Sterling Journal Advocate for notice on conversion of <br />the NIMM Partnership Gravel Pit. <br />2. As required by Rule 1.6.2 (e), please submit proof of the notice to all owners of record of surface and <br />mineral rights of the affected land and the owners of record of all land surface within 200 feet of the <br />boundary of the affected land including all easement holders located on the affected land and within <br />200 feet of the boundary of the affected land. Proof of notice may be return receipts of a Certified <br />Mailing or by proof of personal service. <br />Attached are Proof of Notices to adjoining landowners within 200 feet, surface and mineral owners <br />of the property, and all easement holders within 200 feet. <br />3. The Division received comments from the Army Corps of Engineers, Division of Water Resources, <br />and History Colorado. The letters are attached for review. Please address any comments noted in the <br />letters and make changes to the application as necessary. <br />The Corps of Engineers indicated that work requiring discharge of dredged or fill material in an <br />aquatic site would require the project proponent to notify the Corps regarding a jurisdictional <br />determination.
